Dangerous buildings

Responsibility

Building owners are responsible for the safety of their buildings and structures. For various reasons these may from time to time become a risk to safety of the public. This can range from a loose roof tile or gutter to the possible immediate collapse of a building.

Survey

When we are advised that a building or structure is a potential danger we will inspect the building and make a full report as to its condition. This report may be needed at a later date as evidence to a Magistrates Court.

Other legislation

If the building is listed as a building of Historical or Architectural interest or is within a conservation area it will be referred to the Planning Department who will consider the use of their powers contained in the Planning (Listed Buildings and Conservation Areas) Act 1990.

Informal Notice

If following the survey it is decided that there is cause for concern the owners of the building will be located and contacted to give them the opportunity to carry out any necessary repairs to make the building safe.

Formal Proceedings

If the owner fails to remedy the condition of the building, an application can be made to the Magistrates Court for an order requiring them to do so. If the owner then fails to comply with the order we will arrange for the works to be carried out and recharge the cost to the owner. The owner may also be liable to prosecution.

Emergency measures

There are occasions where for various reasons such as vehicle impact damage, storm damage, gas explosions etc. the condition of the building is such that immediate action needs to be taken. In such circumstances we will attempt to inform the owner and arrange for any necessary temporary works to make the building safe. The cost of this action is recharged to the owner. The Magistrates Court would resolve any dispute over the expenses incurred.
